These Terms of Service govern your use of websites operated by Tumble Wumble Cat Toys Inc., including TumbleWumble.com and TheThumpster.com, and purchases made through our online services.
By accessing our websites, creating an account, or purchasing a product, you agree to these Terms.
Products
Tumble Wumble products are pet toys intended for cats.
They are not children's toys.
Adult supervision is recommended during play regardless of a cat's age, size, or temperament.
Inspect the toy regularly and discontinue use immediately if it becomes cracked, damaged, excessively worn, fails to close securely, or exposes an internal component.
Do not allow pets or children to ingest any portion of the product.
Internal components
Certain Tumble Wumble products contain an internal stainless-steel ball forming part of the self-righting mechanism and a replaceable catnip sachet.
The steel ball is designed to remain secured inside the toy and must not be removed.
Removing the steel ball may damage its internal retention mechanism and may cause the product to become unsafe or defective.
If the ball becomes loose, the housing is damaged, or the locking mechanism no longer closes securely, stop using the toy immediately and keep it away from pets and children.
Small internal components may present a choking hazard if released from a damaged product.
Catnip replacement
Where a product is designed to allow catnip replacement, follow the opening and closing instructions provided with the product.
After replacing the sachet, ensure that the product is fully and securely locked before returning it to your cat.
Do not insert objects that prevent the toy from closing properly.
Product testing and representations
Tumble Wumble does not make claims beyond those supported by the information reasonably available to us.
Materials used in The Thumpster have been tested. Final testing of the assembled Thumpster toy is not yet complete.
Unless expressly stated otherwise on the relevant product page, this should not be interpreted as independent certification of the finished Tumble Wumble product by Tumble Wumble Cat Toys Inc.
Assumption of responsibility
Pet behaviour is unpredictable, and no pet toy is indestructible.
Tumble Wumble Cat Toys Inc. is not responsible for injury, loss, or property damage resulting from misuse, lack of appropriate supervision, intentional modification, removal of internal components, continued use of a visibly damaged product, or use contrary to product instructions, to the extent permitted by applicable law.
Nothing in these Terms excludes rights or remedies that cannot legally be excluded under applicable consumer-protection law.
Orders and payment
Prices, available payment methods, taxes, and shipping charges are displayed through the checkout process.
We may accept payment methods including major credit cards, Shop Pay, Apple Pay, Google Pay, PayPal, and other payment options made available through our checkout providers.
We reserve the right to decline or cancel an order where reasonably necessary, including in cases of suspected fraud, obvious pricing or technical errors, inventory shortages, or misuse of promotional offers.
If we cancel an order after payment has been collected, the applicable amount will be refunded.
Product availability
Products, characters, limited editions, promotions, packaging, prices, and availability may change without notice.
We may limit quantities, discontinue products, restrict sales, or modify promotional offers at our discretion, subject to applicable law.
Intellectual property
Tumble Wumble™, The Thumpster™, character names, logos, designs, artwork, packaging, website content, photographs, videos, animations, copy, graphics, character likenesses, and other original brand materials are owned by or licensed to Tumble Wumble Cat Toys Inc., except where otherwise stated.
They may not be copied, reproduced, distributed, modified, sold, commercially exploited, or used to create derivative commercial products without prior written permission.
Reviews and submitted content
If you voluntarily submit a review, photograph, video, comment, testimonial, or similar material through our websites, you grant Tumble Wumble Cat Toys Inc. permission to display, reproduce, format, and share that material in connection with our websites and organic brand communications.
You retain ownership of your original content.
We may remove content that is spam, abusive, unlawful, misleading, infringing, unrelated to the product, or otherwise inappropriate.
Social media hashtags
If you publicly post content featuring our products using #TheThumpster or #TumbleWumble, you grant Tumble Wumble Cat Toys Inc. permission to repost that public content through our owned website and organic social-media channels, with attribution where reasonably practicable.
Use of these hashtags alone does not grant us permission to use your content in paid advertising. We will seek additional permission before using customer-created content in paid advertising campaigns.
Third-party services and links
Our websites may integrate with or link to third-party services.
We are not responsible for the availability, content, policies, or practices of third-party websites or services that we do not control.
Website accuracy
We try to ensure that product information, pricing, imagery, and website content are accurate.
Occasionally, errors may occur.
We reserve the right to correct typographical errors, inaccuracies, pricing mistakes, or omissions and to update information or cancel affected orders where reasonably necessary.
Governing law
These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without limiting any mandatory consumer rights that may apply based on a customer's location.
